The Kansas City Business Journal recently published an article related to the impact of the government shutdown on an already overloaded bankruptcy caseload in both Missouri and Kansas. Sader Law Firm Managing Member Neil Sader spoke to a reporter for the article “Federal shutdown makes growing bankruptcy caseload worse, KC lawyer says” to provide insight into the recent developments.
Sader, who handles both business and consumer cases, noted that this year his caseload, as well as those of his peers, has been exceptionally high, and the government shutdown has only exacerbated the situation.
“I think people are finding when they start reaching out that there is no one full-time practicing bankruptcy attorney that isn’t relaying to people that we’re extremely busy right now,” Sader said in the article. “All the officers who are practitioners in this field are busy, whether they’re creditor attorneys or debtor attorneys, so it’s often hard to get in quickly because of that, especially here in the Kansas City area.”
Sader also shared information regarding the current bankruptcy court system in Missouri and the changes occurring that will result in changes in decision-making and how cases are reviewed. Trustees hired to administer bankruptcy cases no longer have the budgets to do some discovery or to object to as many actions, particularly actions that are in fairly routine cases.
“The impact on court staff has really been detrimental to the system,” Sader said. “The quality of justice is still high, but the number of decisions judges can write is lower, and they often take longer. That impacts a lot of decisions on litigation.”
